Terms and Conditions (GTC)

• 1 scope

These General Terms and Conditions (GTC) apply to all services provided via the websites heiraten-in-daenemark.dk and  heirat.dk The services are provided by two different companies:

• Express Wedding ApS (Denmark): Responsible for the Premium Plan.
• Express Weddiv SL: Responsible for the starter plan.

By using our services, you agree to these terms and conditions.

• 2 Subject matter of the contract and provision of services

2.1 Starter Plan – Online Application Process (Express Weddiv SL)

1. Contract: The Starter Plan is a partially automated online service provided by the Express Weddiv SL This service includes assistance in applying for a marriage license in Denmark.
2. Description of services: The service includes:

• Automated online prerequisite check: Carrying out an automated procedure to verify the customer’s individual details.

• Provision of an individual document list: Creation of a customer-tailored list of required documents for the application process.

• Registration and document upload in the secure online portal: Enabling the customer to securely upload personal documents and data.

• Creation of a tailor-made application plan and checklist: Preparation of an application plan tailored to the individual needs of the customer as well as a specific checklist. 

• Review and evaluation by experts: Technical review and evaluation of the submitted documents to ensure their completeness and accuracy.

• Preparation of the application form: Creation of an application form tailored to the customer data, which only needs to be signed by the customer.

• Providing quality examples: Providing specific examples to assist the client in optimising their submitted documents.

3. Provision of the service: The service is deemed to have been provided as soon as the individual application plan has been sent to the user/buyer. A refund is excluded after the service has been provided, as the service cannot be reversed due to partial automation and individualization.
4. Buyer’s responsibility: The buyer is responsible for providing a functioning email address and access to the necessary technical equipment. Incomplete or incorrect information may affect the quality and results of the service. The provider is not liable for errors or delays caused by incorrect or incomplete information provided by the buyer.
5. Right to cancel
: Since the Starter Plan is a partially automated service that is provided according to the buyer's individual specifications and begins immediately after the contract is concluded, there is no right of withdrawal according to Section 356 Paragraph 5 of the German Civil Code (BGB).

2.2 Premium Plan (Express Wedding ApS, Denmark)

1. Contract: The Premium Plan is provided by Express Wedding ApS and offers a comprehensive, individual service to assist with the application for a marriage license in Denmark.
2. Description of services: The service includes:
• Strategic case screening and document quality control
• Individual case review and strategic advice
• Direct communication and representation before the Danish authorities
• Preparation and submission of the application to the Danish authorities
• If necessary, reservation and/or booking of a wedding date
3. Provision of the service: The service will be provided after full payment is received. After completion of the initial case setup and review, the service is considered provided and no refund is possible.
4. Buyer’s responsibility: The buyer is responsible for providing the provider with complete and accurate information. Incomplete or incorrect information may affect the quality and results of the service. Express Wedding ApS shall not be liable for delays or rejections by the Danish authorities due to incomplete or incorrect information provided by the Buyer.
5. Special conditions for premium customers: Express Wedding ApS assumes no liability for the accuracy of the information and documents provided by the buyers. The customer is responsible for the completeness and authenticity of the documents submitted.
6. Right to cancel
 and cancellation policy: The right of withdrawal pursuant to Section 355 of the German Civil Code (BGB) applies to the Premium Plan, as it is an individually tailored service. However, the customer has no right of withdrawal if the service has been fully provided and execution has begun with the customer's express consent before the expiry of the withdrawal period.
7. a)Premium Plan customers have the right to withdraw from this contract within 14 days without giving any reason, provided that the service has not been fully provided and the execution has not begun before the expiry of the withdrawal period. The right of withdrawal expires if the service has been fully provided and the customer has expressly agreed that the execution of the service begins before the expiry of the withdrawal period.
8. b)Cancellation period: The cancellation period is 14 days from the day of the conclusion of the contract.
9. c)Exercising the right of withdrawalTo exercise your right of withdrawal, you must contact us (Express Wedding ApS, Valby Langgade 129, st.tv., DK-2500 Valby, telephone number: + 4570726130, info@heirat.dk) by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. To meet the withdrawal period, it is sufficient that you send your notification of exercising your right of withdrawal before the expiry of the withdrawal period.

• 3 Prices and payment terms

1. Prices: The prices for the services are indicated on our websites and include the applicable VAT and administration fees.
• Starter Plan: €490 per pair, plus administration fee of 1900 DKK (approx. €255), including VAT.
• Premium Plan: The prices for the Premium Plan vary depending on the type of service selected. The exact prices are stated on our websites and include the applicable VAT and administration fees.
2. Payment: Payment is made via PayPal, Stripe, bank transfer or other payment methods offered and must be fully completed before the service is provided.

• 4 Exclusion of liability and buyer’s obligation to cooperate

1. Liability for buyer information: The buyer is responsible for the completeness and accuracy of the information he provides. The provider assumes no liability for the accuracy of the information provided by the buyer.
2. Buyer’s obligation to cooperate: The Buyer is obliged to truthfully provide the Provider with all necessary and relevant information required for the proper provision of the service. This applies to both services (Starter and Premium Plan).
3. Legality of the information: The buyer assures that all information provided by him is legally permissible and current. The buyer releases the provider from any liability arising from the unlawful use of information provided by the buyer.
4. Disclaimer for external links: If the website of the Danish Family Court is out of service, faulty or not functional, the provider is not liable. The provider is also not liable for the content and offers of external websites.

• 5 Data protection and confidentiality

1. Privacy Policy: Both providers (Express Weddiv SL and Express Wedding ApS) treat all details and information provided by the buyer confidentially and in accordance with the General Data Protection Regulation (GDPR). Data will only be passed on to third parties if this is required by law or is necessary to clarify matters with payment service providers such as PayPal, Stripe or banks.
2. Disclosure of Data: Personal data will only be passed on to authorities within the framework of the legal provisions and the provision of services, in particular for the application for a marriage license.

• 6 Special provisions for the Premium Plan (Express Wedding ApS, Denmark)

1. Disclaimer for Premium Customers: Express Wedding ApS assumes no liability for weddings that were not carried out due to incorrect information, documents sent too late, late registration at the registry office, late arrival for the wedding date, missing or forged original documents, exceeding the permitted Schengen days or other reasons that are attributable to the client.
2. Force majeure: Express Wedding ApS assumes no responsibility in the event of force majeure, including but not limited to natural disasters, wars, strikes, government closures or entry restrictions. If the marriage cannot take place due to force majeure, no refunds will be made.
3. Assessing the authenticity of the relationship: The assessment of the authenticity of a love relationship is the sole responsibility of the Danish Family Court. Express Wedding ApS cooperates with the competent authorities and provides necessary information and documentation to support the legal assessment of the relationship.
4. Interview invitations: If the authenticity of the relationship cannot be sufficiently proven and an invitation to an interview at the Danish family court is received, please note that interview appointments are usually only available within a period of 2-3 months. All costs associated with travel and stay in Denmark for the interview are borne by the client.

• 7 Final provisions and place of jurisdiction

1. Jurisdiction for the Starter Plan: The law of the Kingdom of Spain applies. The place of jurisdiction is the registered office of Express Weddiv SL in Spain.
2. Jurisdiction for the Premium Plan: The law of the Kingdom of Denmark applies. The place of jurisdiction is the registered office of Express Wedding ApS in Denmark.
3. Severability: Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that comes as close as possible to the economic purpose of the invalid provision.
